If Stare Decisis is the common practice of our judicial system, then is it not true that judges set policy?
So if the lower courts established by the President by a higher court, then the policy is set and it was decided in the bank. Laws are created by the legislature, but the policy in relation to compliance with the law and the law with the Constitution establishes the judicial branch. Why is a big problem for the candidate ESCOTO to recognize the use of stare decisis in simple terms?
Judges should not establish policies, which are the rights of lawmakers. Judges rely on precedence to determine whether a decision rendered by the courts of another is acceptable. However, if there is an error in a decision, the judges in an appellate court could reverse the outcome of a trial.
